Federal Judge Aileen Cannon has dismissed fmr. President Donald Trump’s classified documents case.
Her reasoning was that the appointment of the special counsel, Jack Smith, is in violation of the Appointments Clause of the constitution. She suggested that Jack Smith’s role as a prosecutor on this case was unconstitutional because he was not appointed by the president, nor confirmed by the Senate.
This is a monumental ruling and clears one of the strongest criminal cases against Trump.
Smith almost certainly plans on appealing the case, which came about after it was alleged that President Trump had unlawfully possessed classified national security documents in his home and other locations after he left the White House in 2021.
